Legal Theory Blog: Legal Theory Lexicon: Uncertainty, Risk, and ...
Introduction
First year students soon learn that the law must deal with uncertainty--imperfect knowledge about the past, present, or future. ?What level of precaution is required by the duty of reasonable care when engaging in behavior that might or might not cause a harm? ?How should regulators deal with a new technology (e.g., genetically modified organisms when they were first introduced) when the possible harms (and benefits) are speculative? ?What should a jury do when conflicting evidence makes it uncertain whether a defendant is innocent or guilty? ?What should a judge do when crucial evidence has been destroyed and we cannot know which side it would have (decisively) favored?
Questions like these can be made more tractable with tools developed by decision theorists, economists, policy scientists, and philosophers. ?In this entry in the?Legal Theory Lexicon, we will explore three ideas, "uncertainty," "risk," and "ignorance"--and some related notions, "expected utility," "maximin," and "maximax." ?As always, the?Lexicon?is aimed at law students--especially first year law students--with an interest in legal theory.
Vocabulary
Unforunately, the central ideas that we will investigate are not described by a standard vocabulary. ?So the first thing we need to do is define some terms. ?After that, we can discussalternative vocabularies?used to describe the same underlying ideas.
Here are the definitions:
- Certainty: The term "certainty" will be used to designate indisputable or indubitable knowledge about a state of affairs. ?Thus, an event is certain to occur if it is 100% likely that it will come about. ?An historical fact is certaintly true if there is no basis for doubting or disputing its truth.
- Uncertainty:?The term "uncertainty" will be used to designate any belief that falls short of certain knowledge. ?Thus, the occurrence of an event is not certain if there is a chance that it will not come about. ?Our knowledge about the occurrence an event in the past is uncertain, if there are (all things considered) reasons to dispute or doubt that the event occurred.
- Risk: Risk is quantifiable uncertainty. ?For example, if I toss a balanced coin, the chance of its coming up heads if 0.5 (or 50%).
- Ignorance: ?Ignorance is uncertainty that cannot be quantified. ?Examples are tricky here. ?Suppose that someone has put 100 balls in an urn. ?You do know the balls are either white or black, but you do not know whether there are 100 black balls and 0 white balls, or 99 black balls and 1 white ball, or 98 black balls, and 2 white balls, or any other combination (the sequence ends with 0 black balls and 100) white balls. ?What are the chances that a randomly selected ball from the urn will be black? ?We lack sufficient information to assign a probablity. ?It could be 100% or 0% or any other whole number percentage in between. ?(Notice, however, that we know with certainty that the chances are not 3.14159265%.)
So there are two different kinds of uncertainty, risk and ignorance. ?"Risk" is "quantifiable uncertainty," and "ignorance" is "unquantifiable uncertainty."
Unfortunately, this vocabularly is not used by everyone who writes about uncertainty. ?In particular, many economists use the word "uncertainty" to mean both a lack of certainty and "ignorance" (as I have defined it). ?This terminological carelessness can be traced back to an important paper by Frank Knight:
Uncertainty must be taken in a sense radically distinct from the familiar notion of Risk, from which it has never been properly separated. The term "risk," as loosely used in everyday speech and in economic discussion, really covers two things which, functionally at least, in their causal relations to the phenomena of economic organization, are categorically different. ... The essential fact is that "risk" means in some cases a quantity susceptible of measurement, while at other times it is something distinctly not of this character; and there are far-reaching and crucial differences in the bearings of the phenomenon depending on which of the two is really present and operating. ... It will appear that a measurable uncertainty, or "risk" proper, as we shall use the term, is so far different from an unmeasurable one that it is not in effect an uncertainty at all. We ... accordingly restrict the term "uncertainty" to cases of the non-quantitive type. (Knight, 1921, p. 19)
Knight uses the word "risk" to name measuable uncertainty and "uncertainty" to name unmeasurable uncertainty. ?As long as you are careful to distinguish the two different senses of the word uncertainty, you can avoid confusion, but the best way to avoid terminological confusion is to avoid ambiguity altogether. ?For the remainder of the?Lexicon, I will use "uncertainty," "risk," and "ignorance" as defined above.
Varities of Risk and Ignorance
I've defined risk and ignorance as if they were mutually exclusive, but that is a bit too simple. ?For example, we might have some knowledge about probabilties. ?For example, we might know that the probability of event is within a range. ?Consider our urn of red and black balls. ?Suppose that you know that there are at least ten white balls, but nothing more than that. ?There could be 100 white balls or 99 or 98 or any other value that is no greater than 100 but no less than 10. ?In these circumstances, you know that there is at least a 10% chance of drawing a white ball and no more than a 90% chance of drawing a black ball. ?That means there are some bets that you should take. ?If someone offers you 100 to 1 odds on bet that a white ball will be drawn, you should jump on it. ?But what if someone offered you 1 to 1 odds on a bet that a black ball will be drawn? ?It doesn't seem like you have enough information to calculate the odds.
Likewise, we can imagine having second-order information about probabilities. ?You might know the probabilities for certain. ?Or you might know that there is a 0.5 chance that our hypothetical urn contains 100 white balls and a 0.5 chance that it contains 10 white balls. ?The second-order information would permit you to calculate the likelihood of drawing a white ball. ?It is (0.5 * 1.0) + (0.5 * 1) = .55 or 55%. ?In that case, we would still have a condition of risk. ?But we can also imagine scenarios in which we have incomplete second-order information about probabilities--and hence a combination of risk and ignorance.
For the remainder of the?Lexicon?entry, I will assume that risk and ignorance are mutually exclusive and I will ignore the complexities introduced by second-order information about risk and ignorance.
Risk and Expected Utilities
Decision theory is the discipline that studies rational choice using formal (e.g., mathematical) tools. ?If we put aside the possibility of risk aversion (a desire to avoid risk), then rational choice under conditions of risk requires that we maximize the expected utilities of our actions.
Take a simple example. ?Suppose I have a choice. ?I can bet $1.00 on a coin toss. ?There is a 0.5 chance that the coin will come up heads and 0.5 chance it will come up tails. ?The expected value of a bet that the coin will come up heads is $0.50. ?So if I am offered odds that are better than 50/50 (say 2 for 1), I should take the bet. ?There is a 0.5 chance of heads with a payoff of $2.00 (and 0.5 * $2.00 = $1.00), and there is a 0.5 chance of tails with a loss of $1.00 (and 0.5 * -$1.00 = -$0.50). ?That means that the expected value of the bet is $0.50, the sum of $1.00 and negative $0.50. ?If I decline the bet, the expected value is $0.00, so if I want to maximize my expected utility, then I should take the bet. ?(I am assuming that I derive utility from the opportunities created by having the additional $2.00 as compared to the alternative of no gain.)
The expected utility of a decision is the payoff associated with each possible outcome of the decision discounted by the probability of the outcomes occurrence. ?Maximizing expected utilities is simply making the choice that will produce the largest expected utility.
Decision Making under Conditions of Ignorance
Suppose we have to make a decision under conditions of ignorance. ?We now lack the information to maximize our expected utilitiy. ?So how might we decide when we lack information about the probabilities of of possible outcomes?
For example, suppose it were the case that the introduction of a genetically modified organism (GMO) into argriculture would produce one of two outcomes. ?The first outcome is an increase in the production of a valuable foodstuff with no negative side effects. ?The second outcome is an environmental catastrophe that causes the deaths of millions of persons. ?We don't have enough information to know how likely the second outcome is, but we do know that it is possible. ?What is the rational choice in this situation?
Decision theorists have suggested a number of possibilites. ?Here are some:
- Assume that each possible outcome is equally likely. ?That assumption permits us to calculate expected utilities. ?We would weigh the benefits of the GMO discounted by 50% against the costs of the environmental catastrophe (also discounted by 50%).
- Assume the worst case scenario. ?Decision theorists sometimes call this second strategy the maximin principle. ?We?maximize the?minimum?payoff. ?Some versions of the "precautionary principle" are versions of the?maximin?strategy. ?In our GMO hypothetical, this means we would assume that ecological catastrophe will occur--and presumably the rational decision would be to prevent introduction of the GMO.
- Assume the best case scenario. ?This strategy requires us to?maximize the?maximum payoff--hence it can be called the?maximax?strategy. ?This strategy means that in the GMO case, we would assume that the GMO will produce all the benefits and none of the costs--and hence the rational strategy would be to deploy the new genetically modified crop.
We can imagine more complex strategies. ?For example, we choose the outcome with the highest value of the average of the maximum payoff and the minimum payoff.
Each of these strategies has problems. ?For example, the maximin principle requires us to decide soley on the basis for the worst case scenario. ?That might require us to forgo large benefits to avoid dangers to which we could not assign probabilties--even though we might later gain knowledge that would show that the likelihood of catastrophe was vanishingly small. ?Once we had this knowledge, we might regret having adopted the maximin principle.
Another problem with some of these methods is that they are sensitive to variations in the way that outcomes are described and categorized. ?Consider the choice strategy that assumes that each outcome is equally probable. ?That means that adding new categories of possible outcomes will affect the probabilities, and (as you can easily demonstrate for yourself) different ways of slicing and dicing the outcomes pie will result in different decisions becoming the rational choice. ?Sometimes, the set of outcomes is defined naturally (heads or tails), but sometimes the outcomes are shorthand for alternatives that are complex and can be described in many different ways, each of which is correct. ?And even in the coin toss case, it may turn out that there are neglected possibile outcomes (e.g., the coin ends up perfectly balanced on its side or is snatched in midair by a magpie).
I haven't even begun to scratch the surface. ?It is not clear that there is any general strategy for decisionmaking under conditions of uncertainty that can be justified as the rational strategy--but that is a topic for a whole discipline and not a?Lexicon?entry.
Conclusion
Of course, we have barerly scratched the surface. ?Remember, the point of this?Lexicon?entry is to give you a rough understanding of uncertainty, risk, and ignorance. ?The difference between risk and ignorance is fundamental--and every legal theorists needs to understand its significance.

One of the many ways to bridge the gap between the past and the present is by making a scrapbook.
Scrapbooking: Scrapbooking is a hobby of pasting photos, newspaper and magazine clippings, quotes, memorabilia and other stuffs into custom-decorated albums. People who love both art and memories share the hobby. Thus, combining both in a different artistic expression made scrapbooking existence possible.
Documenting family history and other important occasions and events is a way of preserving the legacy. This is the main purpose of scrapbooking. With a scrapbook around, it will be easy for you to tell stories to your children, grandchildren and the next kin in line. Imagine the bridging of generations. Without a scrapbook, your fallible memory will just fail you. Chances are, you will forget most of your precious memories if not recollect them with so many discrepancies. As they say, pictures paint a thousand words. Hence, to cherish pictures and preserve them in a manner that will not make them deteriorate will also preserve the stories behind them.
Scrapbooking Supplies: Before, scrapbooking is a peculiar hobby. Only a few are hooked by it. Thus, scrapbooking supplies are elusive. However, in today?s modern time when the popularity of scrapboooking is pretty much obvious, there are even stores who give major discounts on scrapbooking supplies.
o Customized Albums: Scrapbook uses customized albums where you put the cropped or scanned pictures and embellishments. These albums come in 2 basic sizes ? 8 1/2 x 11 or 12 x 12. Smaller than those sizes will be inadequate to scrapbooking needs. The former is a familiar size. However, the drawback of using the same is that it has limited space hence, your art concepts will also be limited by the space. The usual scrapbooking album is a 12?12 inch paper to accommodate necessary photos, writing and embellishments.
12?12 size creates more room for creative layouts. Hence, you will no longer worry about the limitations in space. Moreover, you can also select from a plethora of colors, themes and styles. Availability is never a bother.
Aside from the size, you must contemplate if you are going to use a strap-bound, post-bound or a 3-ring album. Strap-bound albums have flexible strap hinge, which allows adjacent pages to lie flat with its hinge unseen. Post-bound albums also allow the adjacent pages to lie flat without separating the pages. 3-ring albums, on the other hand, are the easiest albums to use because you can rearrange its pages readily. However, it can only hold limited pages.
In choosing for a customized album, be sure that the album is archival. It must be made with acid free materials. The paper used must also be lignin free. Use the most appropriate colors you can find, your limit is your imagination.
o Album Refills: If you are planning to do an exhaustive scrapbooking session, better purchase album refills together with your desired album. It will be frustrating to know afterwards that no refills are available or compatible to your scrapbook when you needed them.
o Adhesive: There are a lot of adhesives available these days. Choose one or two that will compliment your scrapbooking project. Some of the popular adhesive brands used by artists are Mod Podge, Glue Dots, Triple Thick, 3D Dots, Xyron and EZ.
o Paper: Different kinds of paper can be used to make your scrapbook artistic, appealing and breathtaking. You can use different shapes and colors of paper to add an air of elegance and style.
o Pair of Scissors: Keep your pair of scissors sharp. This will make cutting and shaping easier.
o Pens, crayons and acrylic paint: Pens, crayons and acrylic paint can improve the artistic side of your scrapbook. You can use them to write something or to color a portion of your album.
o Hole punch
To make holes on the pages, a hole punch is indispensable. Hence, your scrapbooking supplies will not be complete if you don?t have one.

Embellishments like stamps, stickers, tags, laces, tassles, alphabets, beads, eyelets, denim blocks and other things that can make your scrapbook a sight to behold can be incorporated in it.

Amy Winehouse has checked into rehab again, her rep confirms.
The singer "has embarked on a treatment program at the Priory Clinic," her rep tells People.com in a statement. "She wants to be ready for performances in Europe this summer and decided to seek an assessment. She will remain at the Priory on doctors' advice."
She was convinced to check into the Priory clinic on Wednesday by her father, Mitch.

Fear of Failure
The biggest problem facing folks new to cheap scrapbooking is the phobia of failure. Nobody likes to fail, myself included. However , if it was not for failing, I wouldn?t be the scrapper I?m today ? some of my largest learning experiences came from failure.
To overcome this, begin by making an album that you think to fail. If it develops into anything better than a failure, you?re going to be in for a happy surprise!
The hardest part of this advice is to acknowledge that once in a while you will fail and it may hurt, but at the end of the day, it all leads to learning the things which do and do not work in the cheap scrapbooking process.
Getting Results
Leading in from failure is getting results. Now there?s a good slogan I use when talking about cheap scrapbooking which I learned from second hand car dealers, and that is: ?mileage may vary?.
If you give a few people the exact same materials and the same quantity of time to make a scrapbook one is inevitably going to turn out better than the other ? its just the way things happen.

UFC 130 Weigh-in Results
LAS VEGAS ? The near-lovefest that has become UFC 130 came to a partial stop Friday at the official event weigh-ins at the MGM Grand Garden Arena. Main event fighters Quinton "Rampage" Jackson and Matt Hamill each weighed in at 205 pounds for their bout, then engaged in the afternoon's most intense staredown. It was a stark contrast to Wednesday's press conference, where the two shared a couple light moments on stage even before their staredown photo op.
When the fight was booked, Jackson was vocal about not having much interest in the fight. But after Hamill said he planned to break the former light heavyweight champion's will, Jackson took a new level of motivation. And Wednesday's cordiality went out the window Friday in favor of a forehead-to-forehead showcase, Hamill's hands up and Jackson's at his sides.
Hamill told emcee Joe Rogan that the fight against Jackson will be the most important fight of his career.
"This is the biggest opportunity for me to help my career," Hamill said. "I know from Day One he didn't want to fight me, but I promise you one thing ? it's going to be a good fight."
Jackson, who doesn't have a knockout win since his UFC 92 victory over Wanderlei Silva, promised fans he's looking for a finish against Hamill, and that Hamill's comments about breaking his will got him amped up.
"It motivated me to train extra hard," Jackson said. "I was already training hard 'cause it's been a while since I knocked anyone out. But I'm ready to put on a show for you guys and get a knockout."
Co-main event heavyweights Frank Mir and Roy Nelson, though, continued to be almost playful about their fight. The two Las Vegas residents, who share many mutual friends and sometimes train together, each weighed in at 260 pounds, and fought back smiles as they squared off.
Making his return to the UFC after an absence of four and a half years, Jorge Santiago, who most recently was Sengoku's middleweight champion, weighed in at 185 on the nose for his middleweight fight with military hero Brian Stann. Stann was 186 on a Memorial Day weekend card that he has said will be emotional for him as a veteran. That bout opens Saturday's pay-per-view.
And despite trouble making weight in the past, Thiago Alves weighed in at 170 pounds for his welterweight bout against Rick Story, who was also 170 and brings a five-fight winning streak into the event.
UFC 130 airs live on pay-per-view at 9 p.m. Eastern on Saturday and is preceded by a pair of fights on Spike TV at 8 p.m. In addition, three preliminary card fights will air on Facebook at 6:20 p.m.

This is SCIENCE FRIDAY. I am Ira Flatow.
This spring, thunderstorms, tornadoes brought not only deadly winds and rain but intense hailstorms. I actually got caught up in one, myself, this week. And, you know, as you watch these giant chunks of ice pelt everything in sight, you can't help but marvel at how all of this ice gets formed in the sky.
And you know what? It's a lot more complex and fascinating than what we all learn in earth science class, as my next guest will tell you. He's been collecting hailstones, literally picking them up off the ground. He stashes them in his freezer and then dissects them in his laboratory, piercing together and piecing together the journey that they've made through clouds by looking at their layers of ice.
And he's poking into their cores, too, and looking for the essence of their beginnings, and apart from the usual dust grains in the nucleus of the hail, he's found lots of other stuff, like pollen and spores and even living bacteria nestled inside the idea.
Yes, bacteria, lots and lots of bacteria in ice from all over the world, even in ice in Antarctica. What do bacteria have to do with hail and ice? That's what we're going to be talking about first. Let me introduce my guest. Alex Michaud is the Ph.D. student, ecology and environmental science at Montana State University in Bozeman. Alex joins us by phone. Welcome to SCIENCE FRIDAY.
Mr. ALEX MICHAUD (Ph.D. Student, Montana State University): Glad to be here.
FLATOW: Hi. How did you decide - give me - to go around picking up hailstones?
Mr. MICHAUD: Well, it was kind of a sample of opportunity, a chance occurrence. There was a very large hailstorm that fell on Bozeman in June of last summer, and watching them hit the ground with some significant force was very interesting.
And so I went out after the storm was - right after the storm was over and decided to pick some up and put them in the freezer and see if I couldn't look at them in some more depth.
FLATOW: And how do you dissect a hailstone, and what do you find inside?
Mr. MICHAUD: Usually, you - the method that I used was to cross-section them. So cut a thin slice through them, and that allows you to reveal the layers, and then from there just dissecting with a razorblade, you can cut the different layers out and then analyze from there.
FLATOW: And you found bacteria in the center of the hailstones that you can culture?
Mr. MICHAUD: Yes, so that means that they are live or in some sort of state that allows them to persist through that ice.
FLATOW: And then what's fascinating is that in reading of your work, is how it appears - how common bacteria is at the center of hailstones.
Mr. MICHAUD: It is. There seems to be a fair amount of them, you know, on the order of - ones that are alive and can be cultured, about 1,000 per milliliter of sample water that you get from the middle of the hailstone.
FLATOW: And so what's the advantage to - if I'm a bacterium, what's the advantage to me of hanging out in the inside of a hailstone?
Mr. MICHAUD: Well, they need a way to get back down to the surface. It's a pretty harsh environment up there in the clouds, lots of UV, cold, dry, not the best place for a living thing to be, and so it's good to be brought back down to where you have protection in the soil or on a plant surface, much more suitable habitats.
And so whether they come down in hail or rain, it's a good thing to get back down to the surface.
FLATOW: Interesting, and there are certain bacteria that really have an affinity for really creating these ice. We know that ice sometimes needs a little drop of something to form around, needs a nucleus, right?
Mr. MICHAUD: Exactly. You need something to initiate the freezing of water. Everybody thinks, you know, water hits zero degrees Celsius or 32 degrees Fahrenheit, and it freezes, but it needs something to freeze onto.
And so normally water has to cool well below that, if it's pure water, in order to freeze. And bacteria actually do it really well at warm temperatures or more so than bacteria, but also biological particles really help to start that ice crystal formation at warm temperatures, say minus-two degrees Celsius to minus-eight degrees Celsius.
FLATOW: So when these bacteria get to the ground, if they can form ice at a warmer temperature than, let's say left alone, other particles of soot or whatever in the atmosphere, and they land on leaves, aren't they going to start getting ice into the plants themselves?
Mr. MICHAUD: Yeah, that's what's been studied for the last 40 years is these bacteria, as plant pathogens, because they don't allow the water in the plants to super-cool and cool down to the point of not freezing, so these bacteria cause frost injury in plants, and if you disrupt a plant cell, it's going to leak out a bunch of good nutrients and food for you to eat.
FLATOW: So this is a way of getting inside the plant and then freezing at a higher temperature and, sort of like water in pavement breaks open the pavement, water in the leaf breaks open the leaf structure so that the bacteria now have some lunch inside there.
Mr. MICHAUD: Exactly, exactly, and that's a very common - or it's a common strategy for a select few of bacteria.
FLATOW: And if there's a lot of these bacteria floating up in the atmosphere and making it easier for it to rain or for it to hail, would that not affect the weather? Would they not, you know, have some sort of influence in the weather?
Mr. MICHAUD: Yeah, the - some past studies have shown that there are about 40 percent of the nuclei or the initiators of drops of precipitation are biological in origin.
Now, that's not saying just bacteria but other types of biological particles do help begin the process of precipitation. And so yeah, it - biology does play a role in this precipitation process.
FLATOW: Do you think that perhaps certain bacteria evolve to be able to form ice crystals around them?
Mr. MICHAUD: Yes, that's a debate right now in the literature, you know, whether or not bacteria are - were evolved to cause frost injury in plants, or is this a mechanism for getting back down to the ground once they've been swept up into the air by strong winds?
So yeah, it's one of the big questions that we're asking right now.
FLATOW: Here's a tweet that came in from Noah Cort(ph), who says: Does regular, unfrozen precipitation have bacteria, too?
Mr. MICHAUD: In the form of rain?
FLATOW: Yeah.
Mr. MICHAUD: Yes, that's what Brent Christner and others have been studying. You do have live bacteria that do have unfrozen precipitation, such as rain.
FLATOW: So what do you now? Now that you've got all these hailstones, what's your next line of inquiry here?
Mr. MICHAUD: Well, because - hail is really good because it's a kind of record of the storm. And so continuing to analyze those embryos, or the cores, very middle of the hailstone, to show that there are these efficient ice nucleation active bacteria at the core, this allows us to link a function with a bacteria to show that they were present at the site of nucleation.
